Oracle Denies Severance Negotiations Following Mass Layoffs
TL;DR
- Oracle laid off an estimated 20,000 to 30,000 employees via email.
- The company refused to negotiate severance terms or accelerate stock vesting.
- Remote worker classifications were used to bypass WARN Act notification requirements.
- Employees unsuccessfully petitioned for packages comparable to other tech firms.
Oracle recently terminated thousands of employees through email notifications, offering severance packages that included four weeks of pay for the first year of service plus one additional week per year, capped at 26 weeks. The company also provided one month of COBRA insurance coverage.
Many employees expressed frustration that the severance terms did not include the acceleration of restricted stock units (RSUs). Some staff members reportedly forfeited significant amounts of stock that were near their vesting dates, even when those shares were granted as retention incentives.
Some workers discovered they were ineligible for the WARN Act’s two-month notice requirement because the company classified them as remote employees. This classification allowed the firm to avoid the location-based triggers typically associated with large-scale staff reductions.
A group of at least 90 affected employees attempted to petition Oracle for improved severance terms, citing more generous packages offered by other major tech companies. Oracle declined to engage in negotiations, characterizing the offer as a final decision.
When asked for comment regarding the severance terms, the use of remote worker classifications, and the failed negotiation attempts, Oracle did not provide a statement.
Why It Matters
This situation highlights the precarious nature of employment for many tech workers, including a significant number of Indian-Americans who often rely on stock-based compensation and visa-linked employment status. The loss of unvested stock and the lack of negotiation power underscores the limited protections available to tech professionals during industry-wide workforce reductions.
