India Updates Immigration and Visa Rules for Specific Foreign Nationals
TL;DR
- New amendments exempt certain refugees and foreign nationals from standard passport renewal rules.
- Exemptions apply to specific groups from Pakistan, Sri Lanka, Tibet, and neighboring countries.
- Travel documentation guidelines for citizens of India, Nepal, and Bhutan have been clarified.
- Military personnel and foreign military crew members are granted specific travel exemptions.
The Union Home Ministry has issued the Immigration and Foreigners (Exemption) (Amendment) Order, 2026, to simplify travel and visa requirements for several categories of foreign nationals. This update affects refugees and migrants from countries including Pakistan, Sri Lanka, and Tibet.
Pakistani nationals who arrived in India by the end of 2009 with the goal of permanent residency may be exempt from passport renewal if they lack specific identity documentation. To qualify, these individuals must meet strict criteria, including having no property or marriage ties in Pakistan and providing an undertaking to not return.
Religious minorities from Afghanistan, Bangladesh, and Pakistan who entered India by December 31, 2024, due to persecution are also covered under the new provisions. Similarly, registered Sri Lankan Tamils who arrived by early 2015 and specific Tibetan nationals are granted exemptions from standard visa and passport rules.
The order also clarifies travel documentation for citizens of India, Nepal, and Bhutan. While these citizens can use specific identification for direct travel between the three nations, those passing through third countries like China or Pakistan must still carry valid passports and visas.
Additionally, the government has exempted military personnel on official duty and foreign crew members of military vessels undergoing repairs from standard passport requirements. These individuals must carry valid military identification and, in the case of ship crews, obtain specific repair permits.
Why It Matters
These regulatory changes impact the legal status and mobility of various refugee and migrant communities residing in India. By streamlining documentation requirements, the government aims to provide clarity for long-term residents and cross-border travelers while maintaining security protocols for those entering from third-party nations.
